Terms of Service

These terms are an agreement between you and Tech’N Goodwill (T & G) Limited, a company registered in Sierra Leone with its office at 37 Upper Brook Street, off Naimbana Street, Freetown, which operates Trakkam. By creating an account or using the service you accept them. If you are accepting on behalf of an organisation, you confirm you are authorised to bind it.

1. The service

Trakkam is a GPS fleet-management platform. It records positions reported by GPS devices fitted to your vehicles and provides real-time tracking, trip history, geofences, alerts, reports, shareable trip links, and a WhatsApp assistant. Features available to you depend on your subscription plan.

2. Accounts

• You must be at least 18 and provide accurate information.
• You are responsible for keeping your credentials secure and for everything done under your account.
• Account owners control who is invited, what role each person holds, and what data those people can see.
• Tell us promptly if you suspect unauthorised access.

3. Tracking people lawfully

This is the most important obligation in these terms. Vehicle tracking reveals the movements of the people driving those vehicles, and you — not Trakkam — are responsible for doing it lawfully.

• You must have a lawful basis to track each vehicle and to process the location data it generates.
• You must tell drivers and employees that vehicles they operate are tracked, what is recorded, and how it will be used.
• You must only track vehicles you own or otherwise have the right to track, and you must honour requests from the people you track as the law requires.
• You must not use Trakkam to monitor a person covertly, to stalk or harass anyone, or to track a vehicle without the right to do so.

You are the controller of your fleet data; Trakkam processes it on your instructions. See our Privacy Policy for how that works in practice.

4. Acceptable use

You agree not to:

• Break the law, infringe anyone’s rights, or use the service to harm someone.
• Attempt to access another organisation’s data, probe or circumvent our security, or disrupt the service.
• Reverse engineer the service, resell it, or use it to build a competing product.
• Overload the API beyond published rate limits, or automate access in a way that degrades the service for others.
• Share credentials or API tokens outside your organisation.

5. Plans, billing and limits

• Subscriptions are billed per organisation, in advance, for the period shown at checkout. Prices are in Sierra Leonean Leones unless stated otherwise.
• Each plan caps vehicles, users, WhatsApp numbers and how far back trip history can be viewed. Exceeding a cap requires an upgrade.
• Fees are non-refundable except where the law requires otherwise. You can cancel at any time; the service continues until the end of the paid period.
• If payment fails, we may suspend access after giving you notice and a chance to fix it.
• We may change prices with at least 30 days’ notice before your next renewal.

6. GPS devices

Trakkam works with compatible GPS hardware. Unless we supply and install a device under a separate written agreement, you are responsible for buying, fitting, powering and maintaining it. Devices depend on cellular coverage and a satellite fix; where either is unavailable, positions will be delayed or missing.

7. Your data

• You own your data. Vehicles, positions, trips, geofences and reports belong to your organisation.
• You grant us only the licence needed to host, process and display that data in order to run the service for you.
• You can export your data at any time, and request deletion when you close your account.

8. WhatsApp

The WhatsApp integration is delivered over Meta’s WhatsApp Business Platform and is subject to WhatsApp’s own terms. You must only register numbers whose holders have consented to receive Trakkam messages, and you must stop messaging anyone who opts out. Message delivery depends on Meta and is outside our control.

9. Availability and accuracy

We work to keep Trakkam running reliably, but we do not guarantee uninterrupted service. We may take the platform down for maintenance, and we will give notice where we reasonably can.

Do not rely on Trakkam alone for emergencies, vehicle recovery, or decisions where an error could cause harm. Location data is only as good as the device, the satellite fix and the cellular network behind it. Positions can be delayed, inaccurate or absent. Alerts can be late or missed.

The service is provided “as is”. To the extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Suspension and termination

You may close your account at any time. We may suspend or terminate access if you materially breach these terms — in particular the tracking and acceptable-use obligations above — if payment fails, or if we are required to by law. Except where a breach is serious or unlawful, we will give you notice and a reasonable chance to put it right. On termination you may export your data for 30 days, after which we may delete it.

11. Limitation of liability

To the fullest extent the law allows, Trakkam is not liable for indirect or consequential losses, lost profits, lost business, or loss of or damage to vehicles, cargo or data. Our total liability arising out of or relating to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

12. Changes to these terms

We may update these terms. If a change is material we will notify account owners by email at least 30 days before it takes effect. Continuing to use Trakkam after that means you accept the change.

13. Governing law

These terms are governed by the laws of Sierra Leone, and the courts of Sierra Leone have exclusive jurisdiction over any dispute. If any provision is found unenforceable, the rest remains in force.
